Terms of Service
These Terms govern your access to and use of the TuttoPieno platform. Please read them carefully.
1. Acceptance of Terms
By accessing or using the TuttoPieno platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation (e.g. a sports club), you represent that you have authority to bind that organisation to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Description of Service
TuttoPieno provides an AI-powered club management platform that includes court usage tracking, dynamic pricing, no-show prediction and prevention, member behaviour analytics, access control integrations, and reporting tools.
Features available to you depend on your subscription plan. TuttoPieno reserves the right to modify, add, or remove features at any time with reasonable notice.
3. Accounts & Eligibility
You must be at least 18 years old to create a TuttoPieno account. You are responsible for maintaining the security of your account credentials. You must notify us immediately at info@pietrobonazzi.com if you suspect unauthorised access.
Each club subscription may have one primary account holder and multiple staff users, as defined by the plan. Sharing account credentials between organisations is prohibited.
4. Subscriptions & Payment
Billing: Subscriptions are billed monthly or annually in advance. Prices are listed in EUR and exclude VAT where applicable.
Free Trial: New accounts may access a 14-day free trial (Starter plan) or receive a personalised demo (Growth/Pro plans). No payment is required during the trial. At the end of the trial, you must select a plan to continue using the Service.
Renewals: Subscriptions renew automatically at the end of each billing cycle. You may cancel at any time via the account settings; cancellation takes effect at the end of the current billing period.
Refunds: We do not offer refunds for partial months or unused features, except where required by applicable law. If you believe you have been charged in error, contact info@pietrobonazzi.com within 14 days.
Price Changes: We will give at least 30 days' notice before increasing subscription prices.
5. Acceptable Use
You agree not to:
- Use the Service to violate any applicable law or regulation
- Attempt to reverse-engineer, decompile, or extract source code from TuttoPieno
- Introduce malware, viruses, or any code designed to disrupt the Service
- Use automated scripts to scrape, crawl, or extract data from the platform
- Resell or sublicense access to the Service without written permission
- Use the Service to process data of individuals without a lawful basis under GDPR
- Impersonate another person or organisation
Violation of this section may result in immediate account termination without refund.
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy (available at tuttopieno.com/privacy). Where TuttoPieno processes personal data on your behalf (e.g. member data), TuttoPieno acts as a data processor and you act as the data controller. A Data Processing Agreement (DPA) is available upon request and is incorporated by reference into these Terms for customers subject to GDPR.
7. Intellectual Property
TuttoPieno and its licensors own all intellectual property rights in the Service, including but not limited to the software, AI models, user interface, and documentation. These Terms do not grant you any ownership rights; you receive a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes during your subscription.
Your club data remains your property. You grant TuttoPieno a licence to process your data solely to provide the Service. We may use anonymised, aggregated data to improve our AI models and benchmark reports.
8. Third-Party Integrations
The Service integrates with third-party platforms (e.g. Playtomic, Stripe, CourtBooker). Your use of those platforms is governed by their respective terms. TuttoPieno is not responsible for third-party platform outages, data loss, or changes to their APIs that affect integrations.
9. Service Availability & SLA
TuttoPieno targets 99.5% monthly uptime for the core platform. Planned maintenance windows will be announced at least 48 hours in advance.
For Pro plan customers with an active SLA addendum, service credits apply for downtime exceeding the agreed threshold. Credits are the sole remedy for unavailability; TuttoPieno is not liable for consequential damages from downtime.
10. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available". TuttoPieno makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
Financial outcomes: TuttoPieno provides tools and data to help you optimise revenue. We do not guarantee specific financial results. ROI figures cited in marketing materials are based on historical customer averages and are not guarantees.
Limitation of liability: To the fullest extent permitted by law, TuttoPieno's total liability to you in any 12-month period shall not exceed the amount you paid for the Service during that period. We are not liable for indirect, incidental, special, or consequential damages.
11. Termination
Either party may terminate the subscription at any time. Upon termination:
- Your access to the Service will cease at the end of the current billing period.
- You may export your data via the account settings for up to 30 days after termination.
- After 30 days, TuttoPieno will delete your data in accordance with our data retention policy (see Privacy Policy).
TuttoPieno may suspend or terminate your account immediately for material breach of these Terms, fraudulent activity, or non-payment.
12. Governing Law & Disputes
These Terms are governed by Swiss law. Any disputes that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of Lugano, Switzerland.
For consumers in EU member states, mandatory local consumer protection laws may apply in addition to or instead of the above.
13. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or in-app notification. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
